Moziflow Terms of Service

These Terms of Service are an agreement between you and Moziflow concerning your access to the Moziflow website, download of installers, and use of the Moziflow desktop software. By accessing the website or downloading, installing, or using Moziflow, you agree to these Terms and acknowledge that you have read the Moziflow Privacy Policy. If you do not agree to these Terms, do not download, install, or use Moziflow. Moziflow will separately obtain consent for data processing where applicable law requires consent.

1. Scope

These Terms apply to the official Moziflow website, installers, download services, desktop software, and related support provided by Moziflow.

Model services, operating systems, and other third-party products you choose are provided by their respective providers and governed by their own terms.

2. Eligibility

You must have legal capacity to enter into this agreement under the law where you live. A person who has not reached the age to contract independently must have a parent or legal guardian read and accept these Terms and must use Moziflow under that person’s supervision.

If you use Moziflow for an organization, you represent that you have authority to accept these Terms on its behalf.

3. Current Service Status

The current Moziflow website provides product information, pricing presentation, and software downloads. Unless an official checkout flow is available and you expressly confirm an order, references on the pricing page to Free Starter, Pro, monthly or annual billing, or promotional offers do not constitute an available subscription or mean that account entitlements are active.

When account, login, software-entitlement, or paid-subscription features become available, Moziflow will update the applicable terms before they take effect. A paid subscription is formed only after an official checkout flow clearly presents its price, period, and applicable rules and you confirm the purchase.

4. Software License

Subject to your compliance with these Terms, Moziflow grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use Moziflow on compatible devices you control.

You may use Moziflow for personal or commercial creative work and may lawfully publish, license, or sell works you complete. Moziflow does not obtain ownership of your work or a share of your revenue merely because you use the software.

This license does not transfer intellectual-property rights in the Moziflow software, website, brand, interface, documentation, or other proprietary materials. Third-party components remain subject to their respective licenses.

5. Restrictions

Unless applicable law expressly permits it or Moziflow agrees in writing, you may not:

  • copy or distribute components of the Moziflow software other than the unmodified installer;
  • sell, rent, sublicense, redistribute, or provide Moziflow as a managed service;
  • evade, disable, or interfere with software licensing, security controls, or integrity verification;
  • reverse engineer, decompile, or disassemble the software, except to the extent applicable law gives you a non-waivable right to do so for interoperability or security research;
  • use Moziflow to distribute malicious code, attack systems, commit fraud, harass others, or infringe another person’s rights; or
  • impersonate Moziflow or remove proprietary, attribution, or security notices from the software.

6. Your Content and Works

You retain the rights you lawfully hold in your instructions, manuscripts, characters, settings, creative archive, and completed works. Merely using Moziflow locally does not grant Moziflow a license to that content.

When you voluntarily send Moziflow a support message, diagnostic export, or other material, you grant Moziflow a limited, non-exclusive, royalty-free license only to receive, copy, inspect, and process that material to respond to your request, diagnose a problem, maintain security, or resolve a related dispute. This license ends when the relevant purpose ends, except where records must be retained by law.

You must have the right to use content you enter into Moziflow or send to a model provider. You may not use unauthorized works, personal information, or other protected material in a way that infringes a third party’s rights.

7. AI Features and Outputs

Moziflow is software that helps you organize and direct a writing workflow; it is not a model provider. AI results depend on the model you choose, your prompts and context, model settings, and the status of third-party services.

As between Moziflow and you, Moziflow does not claim ownership of your AI output. You may use output to the extent permitted by applicable law and the model provider’s terms. Laws concerning copyright, attribution, disclosure, and protectability of AI-generated material vary by jurisdiction. Merely supplying a prompt or receiving model output does not guarantee a copyrightable work or exclusive rights.

AI output may be inaccurate, incomplete, biased, inappropriate, or similar to material produced for other users, existing works, or public sources. You must conduct human review, fact-checking, and any necessary revision before using, publishing, or commercializing output.

8. Model API Keys and Third-Party Charges

You are responsible for selecting and configuring a model provider, protecting your model account and API keys, and complying with the provider’s terms. Moziflow does not sell model credits and does not pay your model-usage charges.

Model requests you initiate may incur fees. You should configure budgets, rate limits, and usage alerts and review provider invoices. Provider pricing, quotas, availability, content policies, and data practices may change at any time and are outside Moziflow’s control.

9. Local Storage and Backups

Moziflow stores manuscripts and creative archive data in the local workspace you select by default. You are responsible for securing your device, maintaining adequate storage, and keeping an independent and recoverable backup of important work.

Uninstalling or ceasing to use Moziflow does not automatically delete your local workspace. Expiration of a future subscription or online entitlement, or inability to reach Moziflow services, should not prevent you from opening, manually editing, and exporting existing local works in the software, although features that depend on online authorization or third-party models may be unavailable. Termination of the software license for a material breach under Section 13 is governed by that Section.

10. Third-Party Services and Materials

Moziflow may interact with model providers, operating-system features, website infrastructure, or other third-party services. Those services are the responsibility of their providers. Moziflow does not control their availability, security, pricing, policies, or data practices.

Moziflow may include components governed by separate open-source or third-party licenses. Those licenses control within their scope. These Terms do not limit rights already granted to you under a third-party license.

11. Lawful and Acceptable Use

You may not use Moziflow to:

  • violate applicable law or a court order;
  • infringe copyright, trademark, privacy, personality, or other third-party rights;
  • create, distribute, or facilitate malware, fraud, unauthorized access, or other harmful activity;
  • bypass software licensing, automate attacks on services, or impose an unreasonable load on infrastructure; or
  • make a decision with a significant effect on another person while treating unverified AI output as the sole basis for that decision.

You are responsible for content you submit, adopt, edit, publish, and distribute.

12. Updates, Changes, and Availability

Moziflow may release bug fixes, security updates, compatibility updates, or new versions. The current version does not promise automatic updates, and older versions are not guaranteed to remain compatible with every operating system, model interface, or file format.

Moziflow may modify, add, or discontinue software and website features, but will not use a remote change to delete or take ownership of your local works. Material changes affecting purchased rights will be accompanied by notice and remedies to the extent required by applicable law.

The website, downloads, and third-party services may be temporarily unavailable because of maintenance, network conditions, security incidents, or provider failures.

13. Suspension and Termination

You may stop using and uninstall Moziflow at any time.

Moziflow may suspend related online services or terminate the software license if you materially breach these Terms, use the software unlawfully, attack a system, evade licensing, or create a genuine security risk to Moziflow, another user, or a third party. Where circumstances permit, Moziflow will explain the reason and provide a reasonable opportunity to cure, except in an urgent security event, fraud, or intentional abuse.

After termination, you must stop using the licensed software, but you may continue to access and copy your local files and process them with other compatible tools. Termination does not authorize Moziflow to delete, withhold, or lock your local works. Provisions concerning intellectual property, user responsibility, disclaimers, limitations of liability, disputes, and other provisions that by their nature should survive will remain in effect.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MOZIFLOW WEBSITE, INSTALLERS, DESKTOP SOFTWARE, AI WORKFLOWS, AND SUPPORT SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." MOZIFLOW DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, UNINTERRUPTED OR ERROR-FREE OPERATION, NON-INFRINGEMENT, AND DATA PRESERVATION.

In particular, Moziflow does not warrant that:

  • AI output will be accurate, complete, truthful, original, unique, or suitable for your purpose;
  • output will qualify for copyright protection, pass a platform review, be published or sold, or generate revenue;
  • output will not resemble an existing work or lead to a third-party claim;
  • third-party models, APIs, websites, downloads, operating systems, or networks will always be available;
  • the software will detect or correct every writing, factual, continuity, copyright, or compliance issue; or
  • local files, model responses, or settings will never be corrupted or lost because of device failure, user error, malware, or a third-party problem.

Moziflow and its AI output do not provide legal, medical, financial, tax, publishing, or other professional advice. You should seek advice from a qualified professional when appropriate for your use case.

Some jurisdictions do not permit the exclusion of certain warranties. This Section does not exclude non-waivable consumer rights or statutory warranties.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOZIFLOW WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL LOSS ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE, AI OUTPUT, THIRD-PARTY MODELS, LOSS OF LOCAL DATA, BUSINESS INTERRUPTION, OR PUBLICATION OF A WORK, INCLUDING LOSS OF PROFIT, REVENUE, OPPORTUNITY, GOODWILL, OR DATA, EVEN IF MOZIFLOW WAS ADVISED THAT SUCH LOSS WAS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOZIFLOW’S AGGREGATE LIABILITY ARISING FROM THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU ACTUALLY PAID MOZIFLOW DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR US$100.

These limitations do not apply to fraud, willful misconduct, gross negligence that cannot lawfully be excluded, death or personal injury, or any other liability that applicable law prohibits from being limited. These Terms do not limit any non-waivable consumer remedy.

16. Third-Party Claims and Your Responsibility

You are responsible for third-party claims directly caused by your intentional unlawful use of Moziflow, unauthorized use of third-party material, or material breach of these Terms. You are not responsible for a claim caused by Moziflow’s own conduct, a software defect, or Moziflow’s breach of these Terms. This Section does not expand any non-waivable consumer liability or require you to bear a loss without a reasonable causal connection to your conduct.

17. Privacy

Moziflow’s handling of information is governed by the Moziflow Privacy Policy. The Privacy Policy is a separate privacy notice and is not incorporated into these Terms to reduce data-protection rights available to you by law.

18. Applicable Law and Disputes

You and Moziflow should first attempt to resolve a dispute in good faith through support@moziflow.com. If a dispute cannot be resolved, applicable law and a court with jurisdiction will be determined under relevant mandatory law and conflict-of-law rules.

These Terms do not limit your right to complain to a consumer-protection, data-protection, or other competent authority under the law where you live, and do not remove any non-waivable consumer protection.

19. Changes to These Terms

Moziflow may update these Terms as the product, technology, or law changes. Updated Terms will show a new version, effective date, and last-updated date. A change that materially affects the license scope, payment obligations, liability, or user rights will be explained through a prominent notice on the website or in the software, and Moziflow will obtain renewed acceptance where required by applicable law.

A change applies only to use after its effective date and will not retroactively reduce rights you have already obtained. Continuing to use Moziflow after updated Terms take effect means you accept them. If you do not agree, you may stop using and uninstall the software while retaining your local works.

20. General

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect, and the affected provision will be interpreted as closely as legally possible to its original purpose. Moziflow’s failure to enforce a right immediately is not a waiver. You may not assign this agreement without Moziflow’s consent, except for a transfer of consumer rights that occurs by law.
